VIP SMS Tool Privacy Policy

Welcome, and thank you for your interest in the Democracy Works (“we” or “us”) and the Voting Information Project (“VIP”) short messaging service (SMS) Tool, as described in Terms of Service (the “Terms of Service”) for the VIP SMS Tool.

 This Privacy Policy describes the information that we gather from you, how we use and disclose your information, and the steps we take to protect your information provided through our SMS Tool.  By using the SMS Tool, you consent to the privacy practices described in this policy.

 This Privacy Policy is incorporated into and is subject to the Terms of Service.  Capitalized terms that are not defined in the Privacy Policy have the meaning given to them in the Terms of Service.

 1. Your Consent 

 By providing us with your Data, as defined below, you consent to the collection and use of this information in accordance with the purposes described above and this Privacy Policy.  In particular, by sending a text message to Democracy Works, you agree to receive text messages at that number from Democracy Works as described in this Privacy Policy.  You may revoke consent at any time by contacting Democracy Works, including by texting STOP. 

 2. Information We Collect 

 When you use the SMS Tool, you may provide your residential address and your mobile phone number (your “Data”). 

 3. Limits on Uses of Information Collected

 Our primary uses of the data you submit to us is to provide you with the nearest polling place location, contact information for local election officials, and a link to check voter registration status.  We may use your Data in the following ways:

  • to operate, maintain, enhance and provide you with the SMS Tool;

  • to send you administrative notifications, such as security or support and maintenance advisories;

  • to analyze, benchmark and conduct research on user data and user interactions with the SMS Tool; or

  • to address intellectual property infringement, right of privacy violations or defamation issues related to content you input into the SMS Tool.

4. Disclosure of Information 

We may employ third parties to perform functions on our behalf including, without limitation, administering components of the SMS Tool.  We may share your Data with these third parties in order to provide these services.  We make commercially reasonable efforts to confirm that these third parties are prohibited from using your Data for any other purpose.

We may also share your Data with Democracy Works partner organizations, independent contractors and other entities and individuals who work on Democracy Works projects in order to further Democracy Works’s charitable purposes.  We make commercially reasonable efforts to confirm that these third parties are prohibited from using your Data for any other purpose.

We will not sell your Data or any other information we collect about your activity on our SMS Tool.

We reserve the right to disclose your Data as required by law, when we believe that disclosure is necessary to protect our rights, to comply with a legal obligation or a request from governmental authorities conducting an investigation, to verify or enforce compliance with the policies governing the SMS Tool, or to protect the legal rights, interests, or safety of Democracy Works, our users or others.

5. Control Over Disclosure of Data

You may, of course, decline to share your Data with us, in which case we may not be able to provide to you some of the features and functionality of the SMS Tool.  Please note that we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.  We will retain your information for as long as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

6. Our Commitment to Data Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of your information.  If you choose to send us your Data, we will implement reasonable security measures according to our security policy.  We cannot, however, ensure or warrant the security of any information you transmit to us through the SMS Tool and you do so at your own risk.  We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
If we learn of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.  We may post a notice on our website if a security breach occurs or use other means to contact you.   

7. International Visitors

The SMS Tool is hosted in the United States and is intended solely for visitors located within the United States.  If you choose to use the SMS Tool from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your Data outside of those regions to the United States for storage and processing, and by providing your Data through the SMS Tool, you consent to that transfer, storage, and processing.

8. Changes and Updates to this Privacy Policy

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be revised periodically at our sole discretion, as provided in Section 13 of the Terms of Service.  If we modify the Privacy Policy, we will make it available on our website and will indicate the date of the latest revision.  In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change prior to the change becoming effective.  Our amended Privacy Policy will automatically take effect after it is made available on our website.  If you do not agree with any changes to the Privacy Policy, you may stop using the SMS Tool.  Your continued use of the SMS Tool after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
